General terms and conditions

1. Purpose and acceptance

These General Terms and Conditions (GTC) govern the Swiss Moto Pass offer from P27B Sàrl, Route du Piadelée 27B, 1965 Savièse (hereinafter “P27B”).
Any order placed on the www.swissmotopass.ch website (hereinafter the “Website”) implies acceptance of these General Terms and Conditions.

2. Description of the Swiss Moto Pass

The Swiss Moto Pass is an offer aimed at motorcycle enthusiasts. Subscribing to the Swiss Moto Pass gives the holder access during the period of validity to preferential offers from partners, for example in the fields of motorcycle maintenance, tourism (accommodation, restaurants) and various activities.

3. Subscription

Subscription to the Swiss Moto Pass is made via the Internet Site. It is valid for one year and begins with the activation of the Swiss Moto Pass by P27B after receipt of the customer’s payment. Available payment methods are indicated on the Web Site.
Subscription is firm and irrevocable. No refund will be made in the event of non-use or return of the Swiss Moto Pass.
The Swiss Moto Pass is delivered to the customer in both electronic and paper format, sent by post to the address indicated by the customer at the time of ordering. For shipments outside Switzerland, additional charges may apply. P27B is not responsible for any loss or theft during shipment. The customer must inform P27B immediately if he/she does not receive his/her Swiss Moto Pass within the usual period after ordering, so that P27B can deactivate it and issue a new one. The same applies if the customer suspects misuse of the Swiss Moto Pass.

4. User account

Upon initial subscription to Swiss Moto Pass, the customer must create a user account. Customers are responsible for keeping their user name and password confidential, and for any use made of them.
By creating a user account, the customer agrees to receive communications by e-mail. The customer must notify his user account immediately of any change in his contact details. P27B may validly send notifications by e-mail to the last e-mail address indicated by the customer.

5. Partner offers

Partner offers are shown on the website. In the event of discrepancies between the information published on the Website and that contained in other communications (newsletters, posts on social media, printed documents, etc.), the current data on the Website shall prevail. Information on offers comes from partners, so P27B cannot be held responsible for any errors or omissions. Offers may be subject to conditions and may only be available in limited quantities or for a limited time; some offers require prior reservation. P27B does not guarantee that offers are available to all customers at all times. Benefits not used within the validity period of the subscription are neither refundable nor transferable.
To benefit from an offer, the customer must contact the relevant partner directly and show their Swiss Moto Pass. P27B is not a party to the contract concluded between the customer and the provider in connection with an offer and therefore bears no responsibility in this respect, for example in the event of poor performance of the promised services. Any complaints in connection with the offer must be addressed exclusively to the partner concerned.

6. Data protection

P27B processes personal data within the framework of the subscription and implementation of offers, mainly the data communicated by the customer in his/her user account. By taking advantage of an offer, the customer accepts that his/her personal data may be passed on to the partner concerned. All processing by P27B is carried out in compliance with the Federal Data Protection Act and the Data Protection Declaration available on the Website.

7. Intellectual property rights

All contents of the Website are the exclusive property of P27B and/or its partners.

8. Liability

P27B’s liability is excluded to the fullest extent permitted by law.

9. Modification of the General Terms and Conditions

P27B reserves the right to modify these General Terms and Conditions at any time. Any updates will apply immediately to new subscriptions and renewals. In the event of contradiction between these General Terms and Conditions and the specific terms and conditions of an offer, the latter shall prevail.

10. Applicable law and place of jurisdiction

These terms and conditions are governed by Swiss substantive law, to the exclusion of the provisions of private international law. Any dispute shall be submitted to the competent courts in Sion, Switzerland.
